TPS Registration Process for Ukraine and Sudan

On April 18th, the Department of Homeland Security published two Federal Register notices about TPS for individuals fleeing Ukraine and Sudan. Earlier this month, Alejandro Mayorkas, Secretary of Homeland Security declared an TPS designation for both of these countries for 18 months. It is estimated that there are about 60,000 individuals from Ukraine in the U.S. who may be eligible for Temporary protected status and approximately 3,100 individuals eligible for TPS under the Sudan designation. The Department of Homeland Security has announced that the registration process for both Ukraine and Sudan will begin on April 19th so all those seeing TPS under this designation need to file an application. In order to be eligible under Ukraine Temporary Protected Status, you must have lived continuously in the United States since April 11, 2022 and had continuous physical presence in the United States since the designation date in the Federal Register notice.

Are Ukrainian nationals living outside the U.S. eligible?

No, they are currently not and would not become eligible by moving to the United States now. If you find yourself seeking help, it is advised to apply for a visa or other asylum path at a U.S. consulate in your country.

In order to be eligible under Sudan TPS,

You must have lived continuously in the United States since March 1, 2022, and had a continuous physical presence in the United States since the designation date in the Federal Register notice. Those who have arrived in the U.S. after March 1, 2022 are not eligible for Temporary Protected Status and are subject to removal if they are in the U.S. unlawfully.

To apply for TPS

Submit Form I-821, Application for Temporary Protected Status (during the 18-month initial registration period that runs from April 19, 2022, through Oct. 19, 2023). You can file the form online and at the same time applicants can request an Employment Authorization Document by filing Form I-765, Application for Employment Authorization, alongside Form I-821.
